Dalam persidangan yang digelar Rabu (2\/1), dinyatakan gugatan pihak penggugat ditolak.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hal ini disampaikan Wakil Ketua Pengurus Yayasan STKIP Budidaya Binjai M Yusuf SH. MH, yang mengaku menghadiri putusan persidangan di PN Binjai.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;hasil sidang putusan menyatakan gugatan pihak penggugat ditolak, berarti dengan sendirinya dari sisi kemenangan ada di pihak tergugat, yakni Budidaya dan Ahli Waris,&#8221; kata Yusuf, saat dihubungi via seluler, Rabu (2\/2) malam.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kendati demikian, Yusuf bilang ada waktu 14 hari bagi pihak penggugat untuk melakukan banding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;jika dalam 14 hari kedepan pihak penggugat melakukan banding ya kita hadapi, namun kalau tak ada banding dari mereka (penggugat) berarti selesai lah perkara ini,&#8221; jelasnya.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Untuk diketahui, sebelumnya sidang Perkara sengketa lahan di Yayasan Budi Daya telah bergulir sejak sekitar Agustus 2021 lalu. Budidaya dan Ahli Waris dituding menguasai lahan secara ilegal oleh anak pendiri yayasan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Namun Kuasa Hukum Yayasan Budidaya, Yusfansyah Dodi SH, membantahnya. Sebab Alm T. Suharjo menurut Dodi sudah mengundurkan diri sebagai pengurus yayasan dan telah menerima bagian dari yayasan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sehingga dengan bukti tersebut menunjukkan Alm T. Suharjo tidak berhak lagi atas SHM 305 karena sudah diserahkan oleh T. Suharjo bersama dengan pengurus menjadi aset yayasan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Maka menurut Dodi, SHM 305 Tahun 1999 dengan luasnya 3.930 M2 itu secara tidak langsung diakui keberadaannya oleh Tergugat.
